Welcome to QSO Director. These Terms and Conditions (“Terms”) apply to your use of the QSO Director website, software, and related services (together, the “Services”), which are provided by Short Path Limited (doing business as QSO Director) (“Company,” “we,” “us,” or “our”), a company registered in England. By accessing or using the Services, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By using the Services, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Services. These Terms apply to both free and paid versions of QSO Director.

2. Modifications

We may update these Terms from time to time. If we make material changes, we will notify you by reasonable means (for example, by email or a notice on our Services) before the changes take effect. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

3. Age Restrictions

You must be at least 16 years old to use our Services. By using our Services, you confirm that you meet this requirement. If we become aware that an account has been created by someone under 16, we will terminate the account and securely delete any related personal data.

4. Intellectual Property

  • All content, software, trademarks, graphics, and materials made available through the Services are owned or licensed by Short Path Limited and are protected by copyright, trademark, and other intellectual property laws.
  • Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to access and use the Services for your personal or business purposes.
  • You may not copy, modify, distribute, sell, rent, reverse engineer, decompile, or otherwise attempt to extract the source code of the software except where permitted by law.
  • All rights not expressly granted to you are reserved by Short Path Limited.

5. Software in Development

QSO Director and its associated software, systems and services is still in development and as such you accept that the following will apply:

  • Not all features detailed or referenced on the website or from within the software will be available or fully functional yet.
  • Features and capabilities will be rolled out as and when they are deemed by us to be ready.
  • Some features and capabilities may change as the development progresses.
  • Bugs may be more prominent than reasonably expected.
  • Bugs may occur more frequently than reasonably expected.

We may modify, update, or discontinue any part of the Services at any time, including features, functionality, or availability.

While we aim to provide advance notice of significant changes where reasonably possible, we are not obligated to maintain any specific feature or capability.

6. Aggregated and Analytical Data

Short Path Limited may generate aggregated, anonymised, or statistical data derived from the operation of the Services and user activity within them.

Such aggregated or anonymised data may include, for example:

  • band activity statistics
  • propagation or contact trend information
  • system performance metrics
  • general usage analytics

This information will not identify individual users or personal data.

Short Path Limited retains full ownership of such aggregated and anonymised data and may use it for purposes including:

  • improving the Software
  • operating and maintaining the Services
  • generating statistical insights
  • research or development.

Nothing in this section grants Short Path Limited ownership of your personal data as defined in the Privacy Policy.

7. User Responsibilities

You agree that you will not:

  • Use the Services for any unlawful, harmful, or unauthorised purpose.
  • Attempt to gain unauthorised access to the Services, systems, or data.
  • Interfere with or disrupt the security, integrity, or performance of the Services.
  • Share your login credentials with others or allow unauthorised use of your account. You are responsible for all activity conducted through your account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you suspect unauthorised use of your account, you must notify us immediately. We are not responsible for any loss or damage resulting from your failure to safeguard your account credentials.

8. Payment and Refunds

  • Fees for paid Services will be clearly displayed before purchase and may include VAT where applicable.
  • Some Services may auto-renew unless cancelled before the renewal date. If you wish to cancel an auto-renewing subscription, you must do so at least 1 day before the renewal date.
  • All payments are final unless otherwise required by law. Refund requests will be considered only in exceptional circumstances and at our sole discretion, except where required by applicable law.
  • You remain responsible for all applicable charges incurred up to the date of cancellation or termination.
  • Under UK Law we provide a statutory cooling-off period of 14 days, this begins at the point you sign up for a subscription.

Subscription fees may include VAT or other applicable taxes where required by law. Where taxes are not collected by Short Path Limited, you are responsible for any taxes, duties, or similar charges imposed by your local jurisdiction relating to your purchase or use of the Services. Nothing in these Terms limits any consumer rights or tax protections that may apply under the mandatory laws of your country of residence.

9. Limitation of Liability

  • The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
  • To the maximum extent permitted by law, Short Path Limited and its directors, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, profits, or revenue.
  • Our total liability to you for any claim arising out of or relating to the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
  • We are not responsible for services provided by third parties that you choose to connect with through our Services.

The Services are provided as a convenience tool for managing amateur radio activity and records. The Services must not be relied upon for critical communications, emergency operations, regulatory compliance, or time-sensitive contest activity.

Users remain solely responsible for maintaining independent logs and ensuring compliance with amateur radio regulations and contest requirements.

We do not guarantee that the Services will be available at all times. Maintenance, updates, network failures, or events beyond our control may result in temporary interruptions.

10. Termination

  • We may suspend or terminate your access to the Services immediately if you breach these Terms, fail to pay applicable fees, or use the Services in a way that may harm us or others.
  • Upon termination, your right to use the Services ends immediately, but you remain responsible for all obligations incurred before termination.
  • Upon termination, we may retain certain personal data in accordance with our Privacy Policy and legal obligations.
  • Upon termination, your account and associated personal data will be deleted in accordance with our Privacy Policy. However, amateur radio contact log data (QSO records) that you have submitted through the Services may be retained in anonymised or non-identifiable form, or where necessary to preserve the integrity of amateur radio contact records. Such logs may continue to be stored and displayed as part of the Services, but will no longer be linked to your personal account.

11. Privacy and Data Protection

We take your privacy seriously. Please see our Privacy Policy for details on how we collect, use, and protect your personal data in compliance with UK GDPR.

12. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer and ordinarily resident outside England and Wales, you may also benefit from any mandatory consumer protections of your local law.

13. General Provisions

  • Severability: If any part of these Terms is found invalid or unenforceable, the remainder will continue in effect.
  • Entire Agreement: These Terms, along with any applicable licence agreements or policies, constitute the entire agreement between you and Short Path Limited regarding the Services.
  • Force Majeure: We are not responsible for any failure or delay caused by events beyond our reasonable control.
  • No Waiver: If we do not enforce any part of these Terms, it will not be considered a waiver of our rights.
